Disorderly conduct in Michigan is a very broad crime that includes many situations. It encompasses many acts that are considered disruptions to public order. Some of the bases for a disorderly conduct charge include:

•Abusive or indecent language or offensive gesture in a public place tending to incite an immediate breach of the peace
•Abusing or threatening a person in public place in an obviously offensive manner

•Making unreasonable noise in a public place or near a private dwelling he has no right to occupy

•Fighting with another in a public place

•Inciting a Riot

•Disturbance of the Peace

•Loitering in Certain Areas

•Fighting or Physical Altercations

•Obstructing Traffic

The use of profanity, cursing, swear words, or offensive words to police officers, standing alone, also does not constitute a  disorderly conduct.  However, where the verbal conduct causes legitimate safety concerns for the officer and interferes with police operations, the analysis may change. Some Michigan courts have upheld convictions for disorderly conduct where an accused acts in a loud and belligerent manner, directs his yelling towards police, interferes with police operations, and causes a crowd to gather (causing safety concerns for the police officer).

When you have been charged with disorderly conduct offense, you need a competent and aggressive attorney by your side, working for you every step of the way.
