Have you been charged with for
Internet Sex Crime in Michigan?

The prosecution of Internet sex crimes in Detroit and surrounding area has increased in recent years due to a proliferation in child pornography and chat rooms where the online solicitation of minors occurs. Many people charged with an Internet sex crime do not realize what they were doing was wrong. Some people may have let someone borrow their computer and unknowingly committed an Internet sex crime. Additionally, police and law enforcement agencies use sting operations and other entrapment methods to catch people who do not know they are committing a crime.  At THE INDEPENDENCE LAW ASSOCIATES., PLC, our criminal defense lawyers work with investigators, computer professionals, and other forensic experts in defending those facing Internet sex crimes charges.

Protect your rights and your future

Convictions on sexual offenses, including those involving the Internet, carry serious consequences. Among these consequences are jail time and mandatory registration as an online sex offender. Michigan 's sex offender registry can be accessed by the general public and includes pictures and addresses of offenders.

We defend Michiganders who are under surveillance by law enforcement authorities, have been accused, have been charged, or have been convicted of a wide range of Internet sex crimes, including the following:

Production of child pornography for distribution online
Hosting or viewing Web sites containing pornographic images including child subjects
Downloading or distributing child pornography
Internet stalking / cyber stalking
Internet solicitation of minors through chat rooms and other computer-based forums with the intent of initiating sexual contact
Managing or participating in Internet prostitution rings, whether as facilitator, prostitute, or customer

We begin every Internet sex crimes case with a free, confidential initial consultation. Once a client chooses us to defend him or her, we undertake a detailed investigation. We often find that the evidence of the prosecution is inconclusive, was obtained through improper entrapment or other illegal means, or comes from witnesses whose credibility is questionable.

Have you been charged
for Prostitution in Detroit / Wayne County ?

In the major Michigan cities, especially Detroit (including Wayne County) and Macomb , law enforcement agencies have been making numerous prostitution arrests using any number of undercover methods, including:

Sting Operations - Wearing provocative clothing and posing as prostitutes, police officers use this roadside method to lure would-be customers off the street and into the bedroom, only to be arrested for prostitution.

Prostitution Ring Breakups - Using the reverse tactic from sting operations, police officers pose as customers seeking to find sex for hire. Once inside the supposed massage parlors or with the personal escort, the police will make arrests upon determining the falsehood of the organization.

Sex Online - Websites galore offer services for companionship as a cover up for prostitution. Acting as potential customers for these Internet-based sites, law enforcement agencies are able to distinguish the legal from the illegal and make prostitution arrests accordingly. In  Wayne County and Macomb , law enforcement is especially targeting online personal profile ads, such as those seen on Craig's List.org. With increasing Internet usage, sex-oriented websites are under close scrutiny for suspicious illegal sexual activities.

Who Gets Arrested

In Michigan,  both the prostitute and the "John Dow" are aggressively prosecuted for prostitution and solicitation. Innocent citizens with no criminal history can find themselves accused and arrested of one of these crimes simply by being at the wrong place at the wrong time.

PENALTIES

The range of penalties for a Solicitation or Prostitution charge can include:

Community Service
County Jail
Probation
AIDS Testing
Fines
Counseling (court-enforced)
Cal Trans (physical labor)
Loss of employment for those with licenses or government / security clearances
Jail Enhancements: Additional jail time for defendants with prior related criminal charges

Sex Matters

Prostitution charges apply to individuals of either gender, regardless of whether the sexual acts are performed by heterosexuals or homosexuals. However, the majority of Michigan prostitution cases involve female prostitutes with male clients. Illegal in most parts of the country, prostitution, pandering, and solicitation are legal in a handful of states with few condoning licensed houses of prostitution.

In some states, because of overwhelming pressure from the public many prosecutors will stop at nothing to get a conviction. It is important to secure an experienced criminal attorney in preparation for a solid defense.

PROSTITUTION DEFENSE

There are many defenses available to the crimes of prostitution, solicitation, pandering, and loitering. Each case is different and defenses to these crimes depend on what type of evidence is available. The prosecutor must prove at least one the following elements existed to successfully obtain a prostitution conviction:

Solicit (strongly urge or entice) for an act of prostitution
Agree to engage in an act of prostitution
Engage in an act of prostitution

The prosecution will attempt to prove there was an agreement to engage in an act of prostitution. This is usually achieved by means of a recording device during conversations between an undercover cop and the accused. If a record of the conversation cannot be produced, the agreement may be difficult to prove. If the accused has no money on them, the prosecution may have a difficult time proving the specific intent to engage in an act of prostitution.

Your first line of defense is to contact a skilled Michigan criminal attorney right away. Your lawyer will evaluate the evidence and witnesses, question the appropriate persons, and work with you on building your case. The criminal defense attorneys at The Independence law Associates., PLC  will act immediately to preserve any evidence favorable to the defense.

Have you been charged with
for Solicitation of a Minor on the Internet

On-line solicitation of a minor for a sexual purpose, that is, with intent to commit a sexual activity with that minor, is one of the most investigated and targeted activities by both federal and state law enforcement in this day and age. The “on-line solicitation” as it is known as, is usually in the form of contact by electronic mail (e-mail), instant messaging, or other use of the Internet.

Solicitation of minors for sexual purposes on the Internet is an issue that has grown immensely in the past decade. It is a crime that has garnered a great deal of attention; newsmagazine shows highlight "stings" of alleged sexual predators, and the government and advocacy groups widely distribute information to help parents protect their kids. The consequences of a conviction for soliciting a minor on the Internet can be very serious. If you have been involved in or are accused of soliciting a minor, contact an attorney who will explain your rights.

Often, persons are prosecuted pursuant to these laws when a person arranges to meet the minor to engage in sexual activity. However, the person making the on-line communication may be prosecuted even if he does not follow through with contact with the minor, but rather merely communicates in a sexually explicit manner. Also, persons can be prosecuted here if they forward sexually explicit material to the minor.

We defend clients charged for all types of computer and internet sex crimes, such as:

Child porn
Possession of child pornography
Solicitation of a minor over the internet
Other internet or computer crimes

If you are under investigation, or have been arrested for a computer or internet sex crime, contact our experienced criminal defense lawyer to discuss your rights and defense strategy.

Do not admit or deny any accusation. Use your Constitutional right to remain silent!

Do not discuss the case with any family members or friends.

Have you been charged with criminal Sexual
Conduct (Rape) in Michigan?

There are four degrees of Criminal Sexual Conduct (CSC) under Michigan law; they cover a range of sexual contact and levels of force or intimidation.  Jail time for sexual assault crimes can last for decades, with some offenses carrying possible life sentences and 25 year minimum prison terms. Even for convictions of a lesser degree of CSC, the penalties are severe. If You Have Been Charged With CSC, give us a call. These charges range between first and fourth degree. Typically, first and third degree CSC involves penetration, while second and fourth degree CSC result from contact of some other nature.

Your Defense

CSC (criminal sexual conduct ) can be a difficult case for the prosecution to prove, considering such factors as consent or false accusations. Some alleged victims, while caught in the act of consensual sexual intercourse or whose advances are rejected, will cry “rape” when unwarranted. Charges can also be brought about as the result of jealousy, revenge, or from a repressed or recovered memory that can be years old and is unreliable.

In any of the above situations the accused faces false or exaggerated charges. Due to the unpleasant and sometimes upsetting nature of sexual offense cases, a jury may turn a deaf ear to the defense. If you are being investigated for First, Second, Third or Forth Degree Criminal Sexual Conduct, you must call an attorney immediately and do not speak with the police! They will already have gathered some evidence against you and if their case is strong enough they will charge you whether or not you speak with them or not.

Michigan Penalties for a Criminal Sexual Conduct Conviction

1st degree: Up to life in prison and lifetime registration on sex offender list

2nd degree: Up to 15 years in prison and lifetime registration on sex offender list

3rd degree: Up to 15 years in prison and 25 years registered on sex offender list

4th degree: Up to 2 years in prison and 25 years registered on sex offender list

Reminder:

Most important of all of these, KEEP YOU MOUTH CLOSED!   Anything you say will in fact be used against you, what you do not consider a “confession” police or social workers are likely to.   NEVER EVER EXPLAIN anything you have ever done.  They are experts at twisting your words around and making you say things you don’t intend.
